GENERAL TERMS AND CONDITIONS OF SALE


1 – Duration of stay

The contract is concluded for a fixed period and the signatory tenant may not under any circumstances claim any right to remain in the premises at the end of the stay without the prior agreement of the lessor.

2 – Conclusion of the contract

The reservation becomes effective as soon as the tenant has sent the landlord a deposit of 40% of the total amount of the rental.
Payment of the entire reservation will be required for any arrival within 7 days.

The lease concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, natural or legal persons, unless the lessor agrees in writing.

Any infringement of this last paragraph would be likely to lead to the immediate termination of the tenancy at the fault of the tenant, the proceeds of the tenancy remaining definitively acquired by the landlord.

3 – No withdrawal

For bookings made by post, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with Article L121-21-8 of the Consumer Code relating in particular to the provision of accommodation services on a specific date or at a specific interval.

4 – Cancellation by the tenant

Any cancellation must be notified to the owner.

a) Cancellation before arrival at the premises: When the amount paid for the reservation is qualified as a deposit, the commitment is considered final. If the tenant cancels the rental, the landlord keeps the deposit and can ask for the balance of the reservation. If the landlord finds a new tenant for the period in question, the deposit may be transferred to another stay.

If the tenant does not respond within 24 hours of the arrival date indicated on the contract, this contract becomes null and void and the owner can dispose of his gîte. The deposit also remains with the owner who reserves the right to request the payment of the balance of the rental.

b) If the stay is shortened, the rental price remains with the lessor. No refunds will be made.

c) The stay may be cancelled and refunded as soon as an exceptional and unavoidable event prevents the smooth running of the stay or transport (such as the Covid health crisis)

5 – Cancellation by the landlord

The landlord pays the tenant the full amount paid, as well as compensation at least equal to that which the tenant would have borne if the cancellation had occurred on that date.

If the owner cancels the stay, he must inform his customer by email or failing that by phone.

6 – Arrival/departure

The renter must arrive on the day specified and the time mentioned on this contract. In the event of a late or delayed arrival, the tenant must notify the landlord.

Arrivals are agreed between 4 p.m. and 8 p.m.

Departures must be made no later than 10 a.m.

7 – Balance settlement

The balance of the stay must be paid at least one week before the day of arrival.

8 – State of play

The tenant is presumed to have received the property clean and in good condition from rental repairs. The tenant is therefore supposed to take and return the accommodation in perfect condition. End-of-stay cleaning is included in the contract but does not exempt the tenant from the usual cleaning during their stay.

An inventory and a detailed statement of the rented furniture will be made available to the tenant on the day of handover of the keys. The tenant must inform the landlord of any dispute concerning the condition of the gîte within 24 hours of arrival. After this date, the tenant will be responsible for any damage or loss that may occur in the gîte.

9 – Security deposit or deposit

A security deposit of €300 is required upon entry to the premises. This security deposit will be returned to the tenant no later than 3 days after his departure, after the inventory of fixtures and in the event that no damage has been noted. The security deposit will be returned by post or destroyed with supporting evidence.

Otherwise, it will be paid to the tenant after obtaining compensation for the damage observed. If the deposit is insufficient, the tenant undertakes to top up the amount on presentation of supporting documents. This security deposit can in no way be considered as a contribution to the payment of the rent.

In the event of an early departure (prior to the time mentioned on this contract) preventing the inventory of fixtures from being drawn up on the same day as the tenant’s departure, the security deposit is returned by the landlord within a period not exceeding one week.

10 – Use of the premises

The tenant must ensure the peaceful nature of the rental and make use of it in accordance with the purpose of the premises. Respect for a certain art of living is required of all guests to guarantee the tranquility of the place and the comfort of its guests. The group leader will himself ensure the control of the effects arising from the event or its rental in the vicinity of the gîte. In the event of a dispute or complaint, the owner reserves the right to exclude disturbing elements from the cottage.

The children living in Mas Picagnol are under the sole responsibility of their parents or their accompanying persons.

If the landlord finds during the rental period that the tenant has violated the internal rules, the landlord reserves the right to interrupt the stay of the persons concerned by leaving the premises, without any notice. In the event of a claim, the criminal and civil consequences would be the sole responsibility of the tenant.

11 – Capacity

This contract is established for a maximum capacity of people.

If the number of tenants exceeds the capacity, the landlord can refuse the additional people. Any modification or termination of the contract will be considered at the initiative of the customer.

12 – Welcoming animals

Pets are not allowed.

13 – Cottage insurance

The cottage is insured by its owner for civil liability and fire. The owner declines all responsibility in the event of theft and/or damage to the property of the tenant and his guests, including vehicles parked in the car park.

The tenant is responsible for all damages caused by him. He is required to be insured by a holiday type insurance contract for these various risks with his Insurance Company (Rental Civil Liability Protection known as “HOLIDAY”) insuring all the premises entrusted to him, for damage such as: fire, explosion, water damage that could be caused by him or by his guests, during the rental period.

A certificate of insurance issued in the name of the tenant may be requested from the tenant upon arrival.

SAS Mas Picagnol cannot be held liable for accidents or damage that may occur in the property, in the car park or in the manoeuvres of access or exit from the estate as well as on vehicles parked in the car park.

14 – Internet connection

In the event of use of the gîte’s internet connection, the tenant undertakes to comply with the laws regarding downloads and site visits. In the event of a request from the competent authorities, the owner of the gîte will transmit the contact details of the tenant who has benefited from the said connection.

15 – Non-smoking cottages

Smoking is not allowed in the gîtes. Ashtrays are available for smoking outside.

16 – Opening dates of the pool

The pool is open from May to September depending on weather conditions

Within the pool area, children are under the sole responsibility of their parents or accompanying adults.

17 – Electric or hybrid vehicle charging

We inform our kind customers that it is strictly forbidden to charge your electric or hybrid car on the Mas Picagnol electrical network (risk of fire due to overheating due to non-compliant connections). Any behaviour contrary to the rules will be charged €150 per charge.

18 – Use of Gas Grills

It is forbidden to move barbecues from their original location and to light them during high winds. This use is framed in our department by the prefectural order n°DDTM-SEFSR-2019176-0002 of June 25, 2019

These terms and conditions of sale are subject to change at any time without notice. Acceptance of and compliance with these terms and conditions of sale are deemed to have been acquired upon payment of the deposit.
